AN ACT TO AMEND LOCAL AND PRIVATE LAWS OF 1998, TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF SOUTHAVEN TO PAY COMPENSATION TO SUMMERSHILL FIRE DISTRICT FOR TERRITORY REMOVED FROM ITS FIRE PROTECTION DISTRICT; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) Subject to the provisions of subsection (2) of this section, the governing authorities of the City of Southaven, Mississippi, in their discretion, are authorized to supplement the fire protection services of the Summershill Fire District for territory removed from its fire district.

(2) No such agreement shall be entered into for an amount larger than the projected property tax revenues imposed for Summershill Fire District in the territory being released and no such agreement shall be entered into until the removal of such property tax from the individual landowners has taken place.

(3) (a) By agreement of the parties, the City of Southaven, Mississippi, shall pay to Summershill Fire Protection District, as compensation to the district for its loss of tax revenue and dues, an annual amount not to exceed Fourteen Thousand Nine Hundred Eighty-Seven Dollars and Ninety-three Cents ($14,987.93), from any available funds, during fiscal year 2000 and each fiscal year thereafter for the next fourteen (14) years or until some party retires or assumes the current debt of the Summershill Fire Department.

(b) The City of Southaven, Mississippi, shall be fully and wholly responsible for the fire protection within its corporate limits located within the Summershill Fire Protection District and the Summershill Fire Protection District shall be relieved of any further responsibility for fire protection in the areas located within the city limits of the City of Southaven, Mississippi.

SECTION 2. This act shall take effect and be in force from and after its passage.
